I have a toon for sale and some guy just sent isks when i havent confirned anything nor we have agreed about anything yet. The question im asking is... is it a scam or just stupidity? Dont we need to follow the rules?

You can just send the ISK back. If there's no agreement on the price via convo, mail, or the thread then send it back and deny the sale.

Stupidity, in all honesty. If there was absolutely no agreement for the sale of the character in-game or on these forums, that's his fault, and you'd be within your rights to keep the ISK. However, if you're interested in the amount he offered and think it's a fair price, get in touch with him, or send it back and do things the "right" way.

Your call.

I wish for an official response from a gm or dev. Would be strange if they will be obligated to retrieve isks back outside an agreement but would like an official response nevertheless (for future reference regarding the matter)

No one will give you reference without knowing exact situation.
And exact situation varies.

My understanding is that ISK is only "protected" if there was a forum thread and agreement for sale as stated in the rules thread here. If there's no thread and no agreement, the ISK is a "gift".

But don't take my word for it. File a petition for an official answer.

I'm going to be filing a GM ticket, but i will elaborate on the subject at hand. The OP is selling an alt in another thread and i mailed him with a price i was willing to pay. The OP posted my eve mail message on the thread and said "last call". He had 1 other bid that was retracted, and then i posted that i had sent the isk. I had misread his message on the thread and thought he was ready for me to send the isk.

He then mails me that i didnt win the character, then proceeds to outbid me on this alt here in this thread. I will let a GM handle the situation, but wanted to tell the whole situation. OP is just refusing to give me the isk back or even buyout at a higher price where i send him the difference. Hes wanting to let a GM handle it to see if he can get away with the isk.

If the context of ISK transfer was for the toon transfer, and you both have mail about it to prove it, you'll have to return the ISK.

Rules:
Quote:

The ISK that a buyer sends when attempting to purchase a character is considered to belong to him until such a time as the character being purchased has been delivered to the account of his choosing. If the character sale is not completed, the ISK must be returned in full to the potential buyer.

I believe you need to follow the rules of honest living and return his ISK. You didn't earn it and no one "gifts" billions of ISK. Also, taking something that isn't yours is called stealing!

Giggity.

Don't worry, he'll have to return the ISK. The fact that he doesn't want to it's up to GM if he gets suspeded or not.

Well the lame thing is that im still interested in the character. Even after he used his own alt to outbid me, i offered to go 100m higher than what he overbid me by. I was willing to work with him to purchase his character, but since he seems unwilling to return the isk we will put the suspension in the hands on a GM.

This is EVE and even i had to pay for my mistakes. I encouraged him to send a petition so we can both get a proper and clear response regarding the issue. The isks are still on the toon and i will not touch it. If i will get banned for a fault that i did not cause in the first place then i might aswell unsub 4 accounts and give Elite Dangerous another go that i bought last xmas.

The issue is that there was a clear miscommunication in an area that CCP clearly outlines as a place where shady business shouldn't happen (Character Bazaar). This isn't Jita 4-4 and I understand that I misunderstood the context of your post in the thread.

You were trying to tell others that I submitted a buyout via evemail and that it was going to close soon if someone didn't step up (which isn't true because you sniped me on this very alt you're posting on right now). So instead of discussing with me the possibility be paying the difference of a higher buyout option, you're choosing to hold my ISK captive and not allow me to entertain the thought of you selling the character to me. You want to keep the 15.5b I sent you AND sell your character to someone else.

Like I said, this might pass in Jita but not on the Character Bazaar.

Character Transfers and purchases are the one thing that CCP seriously frown upon when it comes to any type of scamming. In the years i've traded characters on here CCP take swift action with any type of scamming.

If you made a genuine mistake sending the isk under the assumption that you were the winner, and he was using a scamming alt to keep driving up the prices............and he doesn't return your isk, he's in for a bad time.

I had a guy pull this one and due to the rules, i'm not allowed to talk about CCPs response.

Smartest thing to do is return the guys isk.

If you want to cry and go back to Elite over a lousy 15B isk, then good riddance to you dude.

Keep your scamming **** in game.

Exact same situation happened to me many moons ago. Dude sent me isk for a char even though i didnt agree to sell it to him in my thread.
I sent back the isk immediately and also sent in a ticket afterwards asking for a dev response to clarify if i could have infact kept the isk and was told in very certain terms that no, i could not treat the isk as a gift and keep it, i had to return it in full ( which i already had ) no room for negotiation what so ever.

The char bizarre is the one place on the forums CCP rule with an iron ban hammer when it comes to sales, they have no choice if they're to keep the confidence players give them when it comes to these things.

I'll also add your the worst kind of bottom feeder for even contemplating you'll get away with it.

You do mind giving the ISK back, because if you didn't mind you would have done it by now. If you think holding on to the 15.5b in hopes that the GM will rule in your favor is worth the risk of you getting the hammer - fine with me

Isk sent back since there was a case like it before. fyi if using an alt to raise price is scamming then 75% of ppl here would be banned. its not eve illegal to do so.Technically, there is no scam going on here since the bid is still ongoing.
