Reading the dev-blog trying to understand the changes from the past two years:
http://community.eveonline.com/devblog.asp?a=blog&nbid=73443

"If I can legally attack the owner of a container, then I can legally take from the container." in in there under legality thread.

So if I am reading this correctly... if I am mining and someone takes my stuffz... I can take it back without getting flagged?

one teeny weeny issue though, if your stuff are in his/her cargohold, you can only get it back by shooting at him/her.
Once you fire at them, they can freely fire back.
So care when you try that

If it's in the cargo hold, yes.

To flip, though, when they take from your can they become suspect, and Concord stops caring about them, for 15 minutes. If they jet a can of their own and put your stuff in it, the can is suspect too, and you can take from it without going suspect yourself. Free to shoot them, free to take their stuffs (anyone can do this, not just you).

So, the can flippers have had to adjust their tactics, because of this.

Either:

1. They have a neutral alt in tow. They come, take your stuff, become suspect, and jet your stuff in their can. Then immediately the "neutral" alt takes from the suspect can and jets (your stuff) again in his own "neutral" can. And now you're forced to take from a "neutral" can if you want your stuff back, which will make YOU suspect and free-for-all to shoot.

or

2. They keep your stuff in their ship, hoping that you'll shoot them when they go suspect, so they can kill you (their ship is tanked).
