Fixed window capping FPS at 40

The "fixed window" option works like crap on my computer. It does limit the FPS at exactly 40, instead of 60.
Now one might think my computer can't handle more. Wrong. Disabling V-sync FPS stays permanently at 200+

It doesn't stay at 40 all the time, but jumps from 40 to 60 and so on.
I had this issue since forever on all computer I had, but never really bothered, because I could play in fullscreen mode. Now that I have more than one display, I need fixed window.

System specs:
i7 920
GTX480
6GB RAM
