That is a matter of opinion and depends on how it is made. Cake is typically baked, for example New York cheesecake is baked and thus a cake, other cheesecakes are not baked but chilled and are thus not cakes.

To put it in perspective some claim it is a cake, some claim it is a tart and others claim that it is a pie.

That a cake is typically baked, does not mean all cakes are baked.

It can be a cake without baking, as infact most cakes are.
When is the last time you had a "baked" cake?
You cant bake a chocolate cake, nor, my favorite, a nordic delicacy "Prinsessa Kakku", or it will be ruined.

By the same argument kittylitter contains cat... Not all pies have a pastry covering, some pies do indeed have layers and many cheesecakes do have a crust, like pie. There is nothing better than an awesome slice of pie with the possible exception of a fantastic slice of cheesecake.

Swedish Apple Pie, where the "crust" is actually more akin to what is known as a crumble, Dutch Apple Pie is open at the top and French Apple Pie is baked upside down so that the apples caramelise and form the top.

If they do not include cheese, and are not cakes, they are not cheesecakes.

No cheesecake is a pie or tort.
