How are people inventing T2 BPC's with ME's higher than 5?

I've noticed ME8 and ME9 T2 BPC's but looking at the decrypters, 5 should be the highest possible. Thanks in advance for any info!

Two options:
1. Some T2 BPCs were retroactively gifted extra levels when Crius landed, those are a one off, and any new ones made after Crius cannot exist.
2. Some are copies from a T2 BPO researched to that level.
