Jaffacake: cake or biscuit?

Difference between cake and biscuit is that a biscuit goes soft when it gets stale and a cake goes hard.

I know this from watching QI.

the UK Customs & Revenue took Mcvities to a tribunal over the non-payment of VAT on Jaffa Cakes as the Tax people were unhappy at calling it a zero-rated cake

The Tax people said it was a biscuit and so Mcvities had to pay VAT.

Mcvities said it was a cake and therefore VAT free.

The tribunal (Yes a committee sat and considered this Big smile) said it was a cake with a few biscuit features

So Mcvities Won therefore it is a cake Big smile

omg, when I lived in the UK (First 30 years of life), one of my friend's dads worked for McVities and he was very well loved (mostly because his house was never out of biscuits!).

In other Jaffa Cake news, when I was in France recently I discovered Pims which are the most awesome jaffa cakes in the world, even better than M&S's*. They had thick dark chocolate on top, not the chocolate favoured coating that Mcvities have. Though obviously you have to be careful not to mistake them for Pimms and mix them with lemonade and serve to your friends on a hot summers day, as they will think you're mad.

*M&S's jaffa cakes also loose points for being rectangular, which is against nature and against god.
