Hence, Jaffa Cakes are cakes.

The court ruling was for tax purposes. biscuits don't have VAT on them. Chocolate biscuits do, as they're a luxury item. Cakes don't have VAT.

So, a Jaffa Cake being a cake means no VAT.

The important thing being that both cake and non-chocolate biscuits are therefore considered essential items, and should obviously be eaten at every opportunity.
