My only issue with ECM is that you should not be flagged as a "suspect" for using it on a target that TARGETED you first but still hasn't fired a shot.

Now, if you ECM a ship that hasn't targeted you, that is a hostile act.

That's like being arrested for knocking the gun out of someone's hand who just pointed it at you but didn't fire a shot.

No. If you are negatively impacting the ship you are targeting, even if it's intended as a pre-emptive act, you should be flagged. Otherwise, you'd have neutral ECM alts screwing up everything.
