Post-Patch: Cannot use Mining Drone II

Pre-patch I could use Mining Drone II now I cannot. I know that a new skill was added but shouldn't we be credited for already being able to use the item pre-patch versus post-patch?

CCP gave plenty of warnings that this would happen to give you time to train the skill in question. It's not their fault you didn't do that.
