You have many choices depends on your individual preferences:

1. If you want to mine semi-afk you cannot use Covetor/Hulk/Mackinaw/Retriver. Only Procurer or Skiff because it have enough tank. Gankers always attack easiest targets so you're pretty safe in your procurer. Google "Procurer tank fit".
2. If you want to mine and look on screen all the time you can use Covetor/Hulk/Mackinaw/Retriver, BUT:
a) Go to zkillboard, check your system and other close systems in region.
b) Check who is ganking there (usually).
c) Add their corps with terrible standings to contacts.
d) Check in which hour they usually play. In my mining systems only 3 groups ganks. One group can be paid&follow the rules, second group is ganking every day the same hours, so I can change my Covetors to Procurers when they are starting to hunt, and last group I just watch local 100% of the time (mining on 3 accounts). It's still dangerous to mine with other ships then Procs or Skiffs, but you can minimize the risk.

Better then crying on gankers thing on this:
more ganks->less miners/afk miners->less minerals->higher prices for you. If you want to mine afk get an Orca:D

As long as CODE don't jettison miners corpses at gates as a warnings I don't see the problem. Content is content.

The Code isn't bad: If you follow it you are save from CODE and other gankers. They just wrote down the way people should act in Eve to be safe and now want to charge extortion money. So follow the Code and there is no reason to pay for protection from CODE cause they will find a loophole in the Code to kill you anyway.
If they, or anyone else, can kill you, you violated the Code anyway.
Just a good advice: create your own jump marks in Belts far away from the "normal" jump in. That will give you the time to get away.

If CODE ever talks to you, remember that they are basically in-game organised criminals e.g. the Mafia or the gangs of Chicago and respond accordingly.

There is no 100% effective way of miners (and others) avoiding their civic responsibilities if they live in,work in or visit James 315 space (Highsec). You can even ship-spin in a Code-compliant manner if you make sure your activities are related to the Code. It's that simple.

I find the whole CODE thing silly, but the fun kind of silly. Like, going to a carnival and getting your face painted by an artist sort of silly.

I've ganked miners, but I didn't cite any reason beyond "because I can". I've never done it to upset someone, promote or disrupt some behavior, generate a profit, or anything like that. I'm not in it for the tears either. - one guy I ganked complained that he couldn't afford a better DCU (he had a meta 0, not even a named one), so I gave him 10 mil to replace his ship and buy better equipment.

I like it as a change of pace and a feat of discipline. Perhaps yes, a gank is down to equations, but there's still a lot of variables and a lot that can go wrong. Trying to track down idle miners, trying to find them in systems with a low enough security rating to give you time to pull off the gank, trying to scan them without them noticing or getting suspicious, calculating the EHP of their fit, clandestinely making bookmarks, try to warp in and stick the landing perfectly and hope the guy hasn't moved in the meantime...it's a lot of hassle and there's a reason I do it so very infrequently. Heck the only reason I got my sec status so low isn't from ganking a lot; it's from accidentally podding a guy.

So citing a "code of conduct" seems entirely superfluous to me. But I won't frown upon people doing their RP thing; it's their game and their way to have fun. My fun is being able to pull it off when I have the patience for it.
