A summary I asked my lawyers to write up today. Many thanks to Mizhara Del'thul for alerting me to this grievous bypassing of fair trade practices.

Quote:
At 0:50 14-12-117 Kulard, Joerva, Wengham, and Loblaw was alerted by our client, Lord Ibrahim of Dar al-Barakah, who retains our firm for the purposes of intellectual property protection, of a possible infringement of a trademark registered as the client's with the CONCORD Patent and Trademark Office. Based on an unsolicited tip the client received it was suspected that there may be a manufacturer and distributor of toy products which, in the mind of consumers, could create confusion which might result in the misapprehension that the items in question had the trademark owner's endorsement.

Our office immediately contracted with an information services company to perform a targeted search for the suspected infringing items using its proprietary algorithms. At 2:10 a small merchant operation aboard the Expert Distribution Retail Center in orbit of Orien II in the Besateoden Constellation of Molden Heath was positively identified as having a product to be in suspected violation of CONCORD trademark protection treaties to which the Republic is a signatory.

The item in question was a large doll or action figure with moderate articulation of the limbs, an electronic voice synthesizer with pre-recorded phrases (such as "I accept children as collateral.", "You will make good on the loan when I sell you at auction!", "Take the house; they can live in debtor's prison.", and "Bah! Humbug!"), and some accessories for the toy (a whip, a coin purse with fake gold coins, and a glass seemingly full of alcohol). The item had a very strong resemblance of the property protected in the trademark. It was sold under the name of "Abraham the Money Lending Slaver".

Station administration was notified of our demand for an order of cessation of the establishment's operations. At 2:30 Station security seized the merchandise as evidence, took the owner into custody, and made the necessary transfer arrangements for the mediation proceedings. A firm associate represented the client's interests remotely. At 3:20 the arbitrator provided by the company with which the station contracts to settle civil disputes reached a ruling in favor of our client and ordered an injunction to stop future violations, the destruction of all units of the product, and restitution to the client (for damages), the station administration (for the cost to bring the action), and the mediation corporation (for its arbitration fee).

Per our client's wish a gift of 10% of the monies recovered for restitution should be marked for Mizhara Del'thul in return for her assistance in bringing the information to light which facilitated the bringing of this action. A payment of 0.55ISK is in the process of being transferred in accordance with this request and the value of the damages as estimated by the mediator (7,500 credits in the local currency).

I can't believe that thing actually existed.

...

On second thought, of course it existed and it was funnier than I thought it'd be. If you'll excuse me I need to contact a few dozen law firms, as many toy makers as I can purchase in the time it takes for them to create an impenetrable web of shell companies and litigation swamps, and start mass producing an infuriating amount of Capsuleer... err... "homages" or whatever the lawyers come up with.

This is brilliant, thank you M'lud Murkie. You have set in motion a project that will surely bring endless amounts of joy and laughter throughout New Eden. You have done a great thing today.
