[OCT] The Onnamon Capsuleer Tribunal is now open

Ladies and gentlemen! Today I present you the new service available to capsuleers - the Capsuleer Tribunal. It is the commercial courtroom dedicated to solving issues between capsuleers and capsuleer organizations. Due to the lack of the enforcement methods the participation in the tribunal activities is voluntary. With this in mind, there are several rules of the tribunal operations:

1. The tribunal session requires presence of at least three judges, one accuser, one defendant and any number of witnesses and listeners.
2. Both sides (accuser and defendant) must agree to follow all instructions and decisions of the tribunal on entering the courtroom before the hearing will start.
3. Any decision of the tribunal requires an agreement of at least two judges.
4. Judges of the session cannot share a role of a witness, accuser or defendant, nor can be involved in the actions consisting the case on either side or as a third party.
5. The tribunal will act according to principles of fairness, and the compensations issued by the tribunal must not exceed the damage that was done.
6. The tribunal will have right to issue fines and must comply with local and CONCORD laws.
7. The tribunal cannot judge individuals and corporations for breaking laws and rules that are under CONCORD or local law enforcement jurisdictions, these cases must be petitioned to the corresponding organizations.
8. The tribunal must follow presumption of innocence.
9. Both the accuser and defendant must have a right to counsel and can appoint representatives.
10. The defendant can't be tried second time on same charges or same facts disregarding the previous tribunal resolution.
11. Each of participants of conflict will have a right to offer one of their own judges.
12. The defendant has right to field a counter-claim, but only if the facts they bring to support their counter-claim has happened prior to their actions that were stated in the claim brought by the accuser. Otherwise they should start a new case.

Capsuleers who are interested in starting the case (plaintiffs), should write NeoCom mail to one of the official OCT judges and provide the following information:
1) Against whom the claim is issued. It can be any capsuleer or capsuleer organization. A capsuleer organization must have a representative(s), whose names must be provided.
2) The plaintiff must clearly state all accusations against the defendant.
3) All the charges must be provided with:
3a) Date of the event (or the first evidence), a period of time can be provided as well, but the first date of that period is obligatory.
3b) Place of the event (either physical or media type).
3c) Very short description of the event.
(For example, 25.11.YC118 - pirating in asteroid belts of Amarr solar system)
4) The plaintiff must provide their demands. (Please note that the Tribunal doesn't guarantee they all will be met even if the defendant will be found guilty. The Tribunal will have the right to lessen the demands if they will be found to be unfair.)
5) Name of the representative must be provided if the plaintiff will require their service.
6) Several names of judges that they find might be interested. The judges must not be already in the provided lists of neutral judges and must not be OCT employees. Please note, that only one of them will be chosen. If none of the names will be provided or none of the candidatures will reply, the tribunal will assign a neutral judge.
7) A list of witnesses or other persons whose presence will be required.
8) A list of witnesses or other persons whose presence will be desirable but can be omitted.
9) A signature and agreement to follow Tribunal rules and instructions.
10) A fee to start the case (it will be returned if the defendant will not agree to participate), must be sent to OCT corporation wallet.

Please note, that all cases will be listed in this forum, even if the defendant disagrees to participate.

A fee to start the case currently is: 200 000 (two hundred thousand) ISK.
Judge wages are: 50 000 (fifty thousand) ISK for each case.

So, a court with absolutely no authority that charges the plaintiff to have the accused laugh at them and walk away with no enforceable penalty leveled against them? Yup, sounds like something to take seriously...

A sort of branded non-binding arbitration. Interesting.

Generally, this sort of representation depends heavily upon reputation, as in, it should be both positive and relatively well-spread.

As an alternative, I've known a few baseliners earning a luxurious living as consulting mediators. You could seek capsuleers with similar experience for your endeavor, perhaps to cultivate that mien of authority.

Courts without teeth are not courts. The whole "voluntary participation" thing will be all well and good for any participants (if any) until they themselves are found guilty, and then suddenly they will revoke that participation. Every single time.

Only the liberty of the individual assures the prosperity of the whole. And this foundation must be defended.

Oh great, this could be helpful... I'd like to bring Tyrel Toov up on the charge of eating the half of a ham sandwich from the fridge in our corporate lounge I left the other day. It was clearly labeled as mine and you knew I was saving it for after that fleet. YOU KNOW YOU TOOK IT, DON'T GIVE ME EXCUSES! I want my sandwich back....

I find myself supportive of any idea or organization who supports lawful interactions between parties. The creation of this Tribunal is a brave step forward, but requires a little more work and thought to become of use to the interstellar community. Please do understand that the vast majority of capsuleers, even those who call themselves Loyalists will mock and laugh at the concept of law. You will find no such attitude among my employees and true loyalists of the State.

If you want arbitration on an issue, then you have to find a neutral third party. If this can become a trusted thing, then it might well become a reliable source of third-party arbitrators.

Just... Don't try to become the capsuleer police. That would lead to lasers and missiles and all sorts of nastiness.

Agreed. Once I see more reputable persons involved in this, maybe then I can take it seriously.
