Eve Online EULA: Possible Canadian Law Violation

Eve Online EULA:

Section 6 Part B Quote "... You may not encourage or induce any other person to participate in such a prohibited transaction..."



The Canadian Constitution Act of 1982 has this in it.

Part 1 Section 2 Fundamental Freedoms.

(b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication;


And I am pretty sure Americans get Freedom of Speech.

RMT is lame. But in North America we do have freedoms. I agree with everything except for for telling people what they can and can not say. I am pretty sure following Federal laws is a requirement of doing business in any country.

Is there some reason why the Eve EULA can skirt this?

Again. I am all for stopping RMT (both ways). But not at the expense of personal rights and freedoms. Especially not for a video game.

I suggest a quick look at your laws on Gambling and the age restrictions, and the associated advertising, etc, that go with them.

Freedom of Speech doesn't allow you say whatever you want... It simply allows you to say something without fear of persecution by the authorities. It's not the same thing.

That protects you from the government, not a corporation.

You signed and agreed to the tos and the EULA mate.
Neither in game nor in the forums is considered a public venue , you can and will be expelled for breaching the rules you have agreed to.

Hey, Fanboi. It's the premise of it all. When you give an inch people take a mile.

But you can be like that. It's your right.

To most of us players, we care not. It doesn't effect me at all.

Put it In the hands of a paid lawyer and they would have a field day. It's all about the details. And Federal Laws in ANY Country CCP is doing business in supersedes this EULA.

Considering I seen some estimate of $600,000 USD (most likely a HIGHLY exaggerated and made up number) of in game currency removed it would be best to play on the side of caution for all parties.

Pass the word on so people know. Hardly anyone actually reads EULAs and just mentioning some site might get them banned and they won't even know why.
