Got Concorded after shooting someone with suspect flag

So, a heron with a clearly flashing orange skull next to his name warps into my highsec mission trying to salvage some of my wrecks next to one of my MTU's.

He warps off after seeing my battleship align towards him so I then come back in my salvager frig to clean up the wrecks, but also equipped with some combat gear expecting him to return.

As expected, he warps into the same spot as before, and still has a flashing orange skull.

So I attacked, and nearly destroyed his heron until Concord came to his rescue.

I don't mind loosing my frig, but I'm confused about the suspect flag.

After reading up on the criminal watch mechanics, you are supposed to be able to attack any player with a suspect flag in highsec, right?

If so, is this something I can/should petition?

I find it highly unlikely that his suspect timer ran out just before I initiated combat, as he still had the orange skull when he warped in 5 seconds before I attacked.

Downside of red safety settings ;)

you sure you ONLY have it "yellow AND flashy" for suspects, and didn't also turn it on for "below zero" sec status?

To avoid this in the future:

1. Turn your safety off of red. If you're running missions, ideally you'd want it set to green. If you had safeties set to green and got CONCORDed, that's likely something you could petition.

2. Double-check your Overview settings. I believe that the default setting for suspect is a flashing yellow icon with a flashing yellow background. If you just saw a flashing orange icon, your target may have been a -2.0 security status pilot, which is NOT okay to freely engage. I'd wager that this is what happened.

3. Be careful shooting suspects at long range with missiles. If they go not-suspect while your missile is in flight and still hit, you will get CONCORDed. It's not pretty.

This is what I am thinking.

OP, did it look like this(1) or this(2)?

If it was the former, I would petition it, if the latter, it was indeed a kill right available and not that he was suspect. If he is orange, you need to activate the killright before you attack. As mentioned, the safety will protect you, keep it on yellow or green unless you intend to lose your ship via suicide gank.

Assuming you are looking for fights, safety should always be yellow in highsec unless you are in warp to a suicide gank target (then set it red while actually in warp, second last thing you do before turning on overheated SeBos) or you are flying logi in a war or AWOX situation (then default to green).

It's a different matter entirely if you live in a different region of space and are just passing through highsec.

Or, you're older than 201x (whenever they put that safety thing in) and are used to it.

Not to mention that some of the best stories I've heard tend to start out with "so, I was an idiot and shot [something stupid cheap] with [something stupid expensive] in hisec..."

I did the opposite. I tried to shoot an Atron in low, with my safety still foolishly left on green from a looooong time age. He escaped as I couldn't drop a point on him :(
