Question about Faction Warfare and Corp Assets in Space

If one of my scouts happened to find, say, a rather juicy looking hisec that we wanted to shoot at and the owners of that POS were engage in faction warfare, would current FW mechanics allow us to shoot said POS without a wardec if we were a member of an opposing militia? Obviously, issues such as hostile faction police and hostile FW participants would potentially complicate such an endeavor, but if it's possible, the ability to hit in hisec without warning may be worth the complications. (EDIT: Another, rather non-trivial, complication would be the fact that they can withdraw from FW at any time.)

Yes. Only thing you might be wrong on is I think FW leaving is done at downtime, but I am not sure as it's been awhile.

FW targets (pilots and structures) are legal targets in all areas of space so I would assume the POS is fair game.
