What's your problem with the news?

What he did was illegal and he is now suffering the consequences of his actions according to the law. What was done to him was wrong and the guilty party is being punished for their actions too. I don't really see a problem or any reason to wow at the news. The monetary compensations are too high in my view, but well within what can be expected in the US.

I am not a fan of civil courts anyway. If I am guilty of anything make it stick in criminal court. I find it ludicrous that one can be found not guilty but still be held financially responsible for something they have been acquitted for. The guard was found not guilty for aggravated battery and official misconduct charges. That seems like the court found him not guilty of any wrong doing. Excessive beating would have falling under both of those charges, therefore the perp should be responsible for their actions and not getting compensated for them....much less 500k

That's not how I understood it.

"A federal jury Friday agreed with Degorski after a three-day trial that Wilson had used excessive force and awarded punitive damages."

Although I don't like the use of the term awarded and the headline which is deliberate sensationalizing (to attract more link clicks to get more ad-revenues), everything I think is important was said in the news piece.

"...regardless of your status in society, you are entitled to be free of unjustified violence at the hands of the government and people with power and the duty to protect you."

AND

"If we accept that there is a sliding scale on whose constitutional rights should be protected and whose should not, we are going down a scary path."

Civil and criminal court exist for two different reasons. Criminal court does not (I believe) provide any restitution to the victim - it is there ito test if someone broke the law or not. Civil court is there to provided restitution. It does not care if an action is legal or not, but whether your actions caused damage to someone else (of course there are a bunch of legal terminologies to determine what can be considered damage to someone else)

^^^ THIS! Yup, a criminal convicted, no matter the crime, goes to prison and that is is sentence. If he'd been sentenced to execution, that should be done right away IMO. But while they are in prison, they should be treated as humanely as possible. Just because you're a criminal doesn't mean that a person in authority should be able to beat you just for the heck of it.

But then, Inmates shouldn't get more opportunities for education and such than the rest of the populous. Some inmates make claims of "I did what I had to to survive the streets"... I grew up dirt poor. We didn't even have a house on numerous occasions, I even lived in a tent for a time. Yet, I didn't go selling drugs, getting into gangs of any sort, or rob people. It IS a choice one makes, it's not pushed on you as if there was never a choice.

A good example of choice here, I fought in Iraq as an Infantryman. I've lost a few friends. But when I actually thought about it, after coming home, I realized I would do no different than the men we fought, were I in their shoes. If someone came to MY country and blew stuff up with an army on our land, I would fight them every way I could. And thus, respect for the Iraqi Insurgent was born. In essence, he was no different than I. I made the choice not to hate anymore. I didn't have to keep stupidly hating someone.

Same goes for people's choices in life. THIS man killed 7 people. It was HIS choice to do so... He's paying for that choice. The guard chose to punch this man in the face. Sure, he deserved it when you consider his crimes he deserved the punch AT THE LEAST, but the guard's job is not to abuse prisoners and he did.

We all make poor choices in life, some bigger than others. But if we start to let things like the Constitution slip to the wayside because of personal opinion... Do we not, then deserve to receive the same as that which we put on someone else?

He's probably never going to see a penny of it. There's state laws on the books that allow the families of his victims to sue him for what he has.

Leadership is something you learn. Maybe one day, you'll learn that.

Having witnessed first hand (Prison Guard, retired) what some of the guards do, I can say that it is not uncommon for guards to be quite excessive in using force, even when they initiate a situation. I have seen inmates beaten even when they were curled up on the floor and never made a single move against a CO. In one of the prisons in the area, I even heard about inmates having their fingers broken for having family members complain to the DOC about living situation. When your prison ends up on Human Rights Watch website, and you are living in a "developed" country, there is a problem.

We've been doing that for a very long time.

  • Gun rights: felon vs ordinary citizen, citizens vs police, etc
  • Religion: Demonization of Western religions (no public broadcasting of your faith, removal of public displays of faith, etc) vs acceptance of others (Minneapolis City Hall Celebrates 'Hijab Day'), etc
  • No knock search warrants and warrantless search
  • "Free Speech Zones"
  • No US flags on Cinco de Mayo
  • In the same vein, school children do not get the same level of rights as those of majority age (car & locker searches, 1st Amendment, etc)
  • Killing of US citizens due to terrorism ties without trial
  • We had internment camps...
  • Oh also, the police have no duty to protect you (Warren vs DC)

Yes he's a bastard but the prison guard caved in the face of an unarmed prisoner. Each of them has to face the music for their actions.
