Pizza and Data Leak.

Yesterday I had something happen that you never want to happen when you deal with a business.
A business and a customer have what is known as a customer-business relationship. It is based on many parts that makes a working customer-business relationship, however all those parts mean nothing if you lose the trust of your customer, since in most cases, once that trust is lost, you also lose that customer.

What happened was that I had an itch for some pizza and wings, so I made an order to a local food delivery restaurant. I was all happy and stuff, because this place sells some amazing wings. My belly growled when I thought about them. Now on their website, they had this little box to leave a comment to the driver. Me thinking to myself, I know of two regulare drivers that deliver, one is a friendly gal, and the other is a pretty chill dude, for ***** and giggles I'll make a request that is a little far out there, plus if they followed through with it, I'd honor my word.
I had put in that if the driver also picked up a gallon of vit D milk and bundle of banana's, I'd give them $10 on top of the tip for the delivery.I normally tip $5 for almost all deliveries, but this time, since I made a request that was a little out there, I tipped $7 for the delivery. From that $10, we take away the cost of the milk and banana bundle, would have left around $4 after costs, the delivery order itself was only $22 plus a 2.75 delivery charge. With a combined total of: $11 tip for a $24.75 order with a special request. I'd consider it a fair tip for an extraordinary request.
Some time later, here comes the delivery man, I was a little disappointed when I saw a lack of milk and banana's, but hey man, dem wings are smelling good so es all good. I start munching on the wings when I get a phone call, here I'm thinking the delivery man got stuck on my driveway since I still saw his lights on my drive way. So I answered the phone while getting my boots on to go out and help push him out, turns out, it was NOT the driver but some random person telling me that this food delivery restaurant posted my order information on facebook. At first I thought that was cool, till he told me that information also included my name, phone, address, and ****. He told me he called me because he wanted to let me know about it and that it wasn't cool of that place to do. No, it wasn't cool at all. I thanked him for doing that-seriously man, good looking out *bro fist*- and called the store right up.
I talked to the person who posted it, and from what I understand it, was a manager. This manager was very apologetic, telling me the post was already taken down, and that it was supposed to be a private not public post. I told her that posting customer information outside the scope of business can land her in some serious legal problems. After some talk she told me all the information was going to be taken down, both public and private.

It would have been ok if this information was posted in an inside network so that the cooks know what food to make, who to call for any issues, and where to deliver. That is A-Ok use of customer information, since the customer willingly gave that information in order to process the delivery. For the most part, this information is kept private between the customer and business.
How ever, posting this information out into the public is a very big no-no. Even though basic information like name, address, and phone number seems like it would already be public (and for the most part it is), as a business, or a business representative to post such information in order to mock or simply because you thought it would for lolz, it can and usually does land you in some serious hot waters.
Lets use an example. Joe from Alaska loves [Giraffe porn], so Joe orders [the latest issue of Giraffe porn monthly], The information required to process this order requires his personal information to exchange hands more times than a speed dating rally. Each exchange of this information is still private since it is used to process and carry out Joe's order of [Giraffe Porn] in a discreet manor. Nobody can simply go ask business ABC if Joe made his order for [Giraffe porn monthly] yet, since businesses cannot disclose that information to outsiders.
Now if business make a public post that Joe order [Giraffe Porn: Camel Hump Day July Edition] because it was funny or what not, with his full name, address, phone number, and other assorted information that comes with taking a picture of that order with zero redaction or bluing, that company is in some serious deep shiitake. They breached the trust of Joe, and also very likely also breached local or higher level law(s).
It doesn't matter what Joe loves and orders, anything can take the place of the brackets.
You can bet that Joe will no longer trust that company, since repairing trust between customer and the business is no easy task.

Now, why am I posting this? Because I want you guys remember, no matter what, when you talk about customers, keep it simple and personal detail free. Instead of posting on facebook, twitter or what have you that Joe Doe from Apple Sauce Street Apt# 777 (123)456-7890 last 4 social #: 0000, last 4 credit card: 0000 came in to your store and sharted all over his pants, click link to see funnyz! LOLZ!
Post that you had a customer come into your store and sharted all over his pants. LOLZ!

As for my case? All I care about is that the information was taken down completely and a lesson learned. I have no plans in sueing, though that may change if I find out my personal information was misused by a different party in connection to this misuse of information.

While I was working as an EMT, I had a very simple method of dealing with privacy laws (HIPAA's privacy protections are reasonably serious stuff).

I have a ****** memory for people.

I'd forget a patients name within moments of them leaving my care (or sooner), and any identifying details within a day. I had people come up to me and thank me, and I'd have to awkwardly fake my way through the conversation until they mentioned whether they were a patient or relative of a patient.

I remember the injuries pretty well, and can tell some decent stories, but it's a toss up whether I'd be able to get the gender right if I wanted to. So a lot of my stories start with "So this idiot in the terrain park..."


Anyway, back to the OP's point, there probably isn't a Pizza Parlor version of HIPAA, and I can't think of any torts that fit the facts provided. The information isn't objectionable (so it's not a public disclosure of private facts), it's not false (so it's not defamation), and it's not misleading (so it's not false light). But I am in no way a legal expert, so it's quite possible I'm missing something (or a great many things).
