I just sold a toon of mine...and left the isk on the toon ... derp... its the buyers obligation to give me the isk on there when they get it otherwise it counts as a scam right?

Yes, they are obliged to. Says so quite clearly in the char bazaar rules. Find the rule that says it, and link it to the person. If they still dont give you your isk, petition.

So, petition it.

Link the character name, the forum post you used and as much information as possible and the Customer Guys will give you the ISK.

Try and have a "peaceful" solution before petitioning. That is what the GM will suggest anyway so if it comes to petitioning make sure you have already tried to resolve it "peacefully" and mention that in the petition.
