Is this an exploit?

Here is the situation

Person A is in a hulk
Person B is an an orca
Person C is in a ganking ship

If person C attacks person A is it classed as an exploit for person A to put it into person B's orca to avoid the loss of the hulk to ganking.

Thank you if you can help.

Concord cannot be avoided.
If you gank someone you must lose your ship.
Any attempt to get around this, from pos forcefields, to orcas/pos hangars and wormholes, are considered an exploit.

No the person being ganked is going into the orca, not the ganker.

Sorry, all the letters confused me.
Dropping the hulk into the orca isn't against any rules.

Short answer. No it is not an exploit.

Long answer. You won't be able to do that because I think you can not scoop/board a ship that does not belong to you that is targeted. See ghost riding.

CCP changed the mechanics a while back so that you're not supposed to be able to scoop a ship if there are active offensive mods targeted against it - i suppose it is keyed to the weapons flag. But regardless, ganking is about alpha. It is highly unlikely that you will have the reaction time to avoid the gank by docking your ship in an orca.

You do not get a weapons flag unless you activate offensive modules someone. I believe the change was in response to gatecampers using orcas to circumvent weapons timers. Gatecamps would have a neutral orca sitting on the gate and, if any of the camping ships were ever in danger, they'd scoop 'em and jump to hisec.

While I cannot say for certain, I am guessing that you can scoop a ship under attack as long as it did not try to retaliate.

You can't store a ship that is locked. If you go global you can't change ships (that includes pods) anyway, so being locked doesn't matter in that case.

If you take all the sand out of the box, only the cat poo will remain.

There's a thread claiming the opposite. (i.e. that you cannot scoop a ship under attack, even if it doesn't do anything.)

But I haven't tested it myself.

If a ship is being targeted it cant be scooped. The player doesn't have to be aggressed or anything, so long as another entity has that ship locked it cannot be scooped to an Orca, carrier etc.

Simple as that!

No, that sounds like pretty smart tactics if you can pull it off.

However you can expect C to do his level best to kill your pod, and he'll have an excellent chance of doing so.

Except if Person A is doing a straight swap - you can switch from flying the Hulk to flying, say, a Blackbird in one step - then I don't think the pod is exposed at all, or at the worst, only for a single tick. I don't know if being engaged or aggressed without an aggression timer of your own interferes with swapping ships from an Orca's maintenance bay.
