I'm not sure if I would consider this plagiarism. It's embarrassing, but it doesn't seem like it would actually be illegal. Did CCP copyright their TOS? That would be kind of like trying to trademark the little symbol people put next to trademarked things.

I am pretty sure you cannot copyright such things as Terms of Service.
Assume, for example, a copyrighted account sharing clause: That would mean that other games cannot legally forbid this? That would be ridiculous.

But yes, it is embarassing.
But not uncommon. I know of one corp that has copypasted their Code of Conduct directly from another corp to the point where the original corp is still mentioned in the text......

You are mixing terms like copyrights and patents.

The TOS is intellectual property. The originator (I hope CCP) put effort and money into creating these terms and probably hired lawyers to check them out.
Only CCP has the right to use and copy (distribute) these specific terms.

Now someone comes along and steals those TOS. This is called plagiarism ... and is a crime in most parts of the world.

We shot them (the company that makes it) this message.

Star Vault:

We here at CCP couldn’t help but notice that our expert wordsmithing, legal poetry and cunning turns of phrase have been emulated with sincerest flattery by your technical writing and/or legal staff. In fact, ardent fans of our EULA have surfaced, themselves noticing your homage to our work. See their assessment here: http://massively.joystiq.com/2011/11/09/mortal-online-plagiarizes-eve-onlines-terms-of-service/

EVE Online is a notoriously dangerous universe. So we have to caution you -- in fact, we demand that you don’t follow our footsteps or use our copyrighted work. After all, internet spaceships are serious business, so probably best to keep our internet spaceship business out of your business language. Please stop using our legal agreements, and kindly remove our name from your website.

This is a kind way of letting them know, way better than rushing in with the legal fist first! And it's good entertainment. Smile

I suggest a hilmar vs "who ever is their ceo" rifter fight. If hilmar wins they need to change their TOS and if the other guy wins they get to keep it.

It's kinda funny because EVE is what inspired Mortal Online in the first place, huge open world on one server, time based skills (that would train faster if you used them, so a hybrid, which to be honest is pretty nice), harsh consequences, a kind of concord in towns, similar PVP, when you die you lose all your stuff you're carrying etc.

It's also made by an Icelandic indie company... but if you've ever been on their forums and read their dev posts, this TOS ripoff wouldn't surprise you.

Shame because MO could be a really cool game, like EVE + Morrowind if it was made with a company that really knew what it was doing.

But in response to quoting you, it could actually be an interesting fight, in fact I bet the CEO of their company plays EVE more than Hilmar... afterall, it's not like they're busy writing their own TOS or anything Lol
