I have kill rights on someone. If I kill them do they get a killright on me so they can retaliate?

Also, I typically keep my safety button on so i dont commit any criminal acts, will that prevent from shooting someone who i have killrights on? Do i have to turn safety off?

You need to find them and activate the killright to be able to shoot them.
This will give them a suspect flag, meaning you and anyone else can legally shoot them.
Once you shoot them, they are allowed to shoot back. (only for this engagement. They will not get a 30-day killright on you)
All of this can be done with your safety set to green.

I though i didnt need to activate kill rights that i already had, they ganked me so i dont have to purchase the rights. How do i activate? Do they get a kill right on me if i kill them when i had a killright?

When you activate your KR, they will go suspect for 15 minutes.

Anyone can legally shoot them in that time. They can retaliate legally against anyone that shoots them first and anyone that provides assistance to anyone shooting them.

Example: You fly an Exequror (a remote repair ship) that has no guns or aggressive modules fitted and your friend flies an Enyo (a small, fast hard hitting ship).

You see your mark and activate your killright. Immediately the Enyo locks the ship and warp scrambles it. At this point, the mark is allowed to shoot the Enyo but not you. If you start repairing the Enyo, or providing it capacitor boosting, you become a valid target too.

You still need to activate it to give them a suspect timer. Find them in space, select them, click on the killright icon.
If you attack them without first making them a suspect, you will become a global criminal, and they will have 30-day killrights on you. You won't be able to do that unless you have your security set to red anyway.

thanks for the help so far, but my main question has not been answered. Do they get a killright on me if i kill them when i already had a killright on them?

Doing this makes you a valid target for everyone as you are interfering with a L.E. (Limited engagement).

You have to select said person, to they're on your selected items windows, then they'll have a small aim icon in the top right cornor.

If you click said aim icon, you will be asked if you want to activate the KR.
Activating the KR will make said person suspect.

So what does that mean for you?
That means you'll get a limited engagement with said person, if you shoot or do anything hostile.

If you're in a limited engagement you cannot receive friendly reps without your reps going suspect aswell, meaning that anyone can shoot them.

However if you have 5 friends with you, you can all engage the guy at the same time without going suspect or receiving a KR on yourself, since you're doing a vendetta on said person.

If you fail to execute said person, the KR will stay, and will be available for you yet again.
That means you can activate said KR again.

And for the love of god don't make it public, it'll just remove it instantly, since he can just die in an ibis.

Upon activation of the killright, your target will turn suspect. That means he can be legally shot by everyone in space.

Keeping your safety on "green" will prevend you from doing anything illegal. That means you cannot turn suspect nore criminal.
Shooting a "suspect" person is nothing illegal. But upon pressing F1 on your enemy, know he is allowed to shoot back.

Here a couple of tipps regarding killrights:
a. your target might realize you have a killright on him. Make sure to prelock the ship - before activating the KR
b. Don't activate the KR on a gate or station, otherwise he will either jump or dock.
c. If you don't have the time to hunt after your target: Hire me/Whores to do it for you Cool (check my bio/forum post)
