Same for me with almost all the trailers.

I hate the way copyright laws are misused and abused nowadys (they are too broad anyway).

I do believe the "sue them" comment was aimed at the ones making the alleged copyright infringement claim, rather than google.

Yeah, Google should keep record on who made the claim, so the one making the false claim should be free target for legal action. Also, Google should in future disregard all claims from that source.

This is exactly how it works. Only a claim needs to be made for YouTube to pull a video down. The claimant does not need to provide any proof; the full burden of proof is on the accused.

One of my friends does a lot of "Let's Play" videos and his videos are constant targets by the automated copyright bots. The false positive rate for the copyright bots on his videos is somewhere near 95%. It's really, really bad. The remaining 5% are almost always someone who owns the background music used in the game, and the typical revenue / advertisements are slapped on the video.

This is a very broken system open to abuse. I believe that there is technically a penalty for making false claims, but I've never heard of anyone being penalized in such a way.

Except they can't. There is literally no repercussions for being wrong about a DMCA takedown notice. In addition, Google is not allowed to ignore them.

Unfortunately the political situation in the US has degenerated to the point that getting rid of even repairing the DMCA is an impossibility.
