GSC blocking a moon from having a new POS being anchored? (in place of an old one already there)

Gentlemen, thank you for reading this. Now on to the question....

Im about to put up a POS at a moon which currently already has one anchored tower and one anchored gsc.
The tower I can take down by a wardec but the container is from a player in npc corporation and as such not possible to blow up.

Will the gsc being there after I have taken down the enemy tower be in the way of me anchoring mine?

Ive read that previously gsc could be put up at moons to prevent people from putting up towers and that a petition would be necessary in order to have it removed. Is that blocking effect still a part of the mechanics of eve and if so, would the fact that there already is a tower in place indicate that this is not a problem in this case, since the gsc is not at the exact spot of where towers will be anchored?

As you understand I cannot test this until i have actually gone to war and taken down the tower, at which point speed is of the essence. And I do not want to risk alerting my enemy by petitioning a gm in advance to remove the container.

Thoughts?

you can always try it on test server,,,,,put up a tower and anchor the gsc the same distance away...take the tower down and reanchor? hope this helps

You can file a petition to have the GSC removed once you've taken down the tower.

If there is a tower already anchored at the moon, then the container is not blocking. You cannot anchor a container within the force field, and you only need 5 km around the tower to anchor a control tower, and force fields are larger than that.

Since NPC player corps cannot be wardeced, the container cannot be destroyed, and that is solid grounds to petition for the container to be moved if it is blocking. I'd use a stuck petition, because I think that qualifies as literally being unable to proceed (with anchoring).

i gave it a try and placed the POS 250km from the can. The POS then moved itself right next to the can (3km away). After which I placed all the stuff I needed. Couple days later I right clicked the secure can and I was able to remove it. Try placing the POS away from the can, worked for me.
