So an unknown assailant tried to kill Tibus Heth. Suddenly CONCORD decides to enact the RETRIBUTION ACT, allowing Capsuleers to police themselves more openly. So, who hates Capsuleers the most? Who despises their power and influence and manipulated the Empires into war and chaos?

This sounds exactly like something the nefarious Broker cooked up to once again manipulate things according to his will and schemes.

Guess who's back...back again...

Edit: Also forgot to mention The Broker is not a big fan of Tibus Heth even though he put him into power.

The Broker is dead, he was even before the minmatar Thukker attack on Yulai.

As the only Faction Leader who is not a capsuleer, I think perhaps he was a hold out, vetoing or blocking this vote/result.

Remove him from the process and it passes, seems very convenient to me

Which also died, all of them. If he wasn't he would have healed himself two or three days later and we would know of him by now.
Also, he had to be extremely desperate to come up with that plan of crashing a Nyx on Otro's head. That wasn't a way of achieving anything other than vengeance against Otro for his certain death.

If he didn't lost all hope of healing before dying when Otro told him again that no, he wasn't going to give him the thing, he would have sealed his own destiny with that action, for all he knew at the moment. So he's most certainly dead since the moment he collapsed after shutting Tripwire down.
