Why didn't I get killrights on this pilot?

IVe killed a pod in lowsec to give someone a lift home, went GCC to do it but it didn't result in him having killrights on me

Also as you said you started fighting back (Even if it was ECM) And that alone means you won't have killrights on them for the ship destruction.
