HS podding legal?!

currently there seems to be some exploit allowing people to attack others who have bounties on them in highsec with out getting concordokkened, just happened to some one i know outside jita and he was not suspect nor criminal. and the players who ganked him were in t3s and even PODDED him. wtf is going on?!

If the player is criminal, suspect or LE flagged, podding is legal.
If you are absolutely sure the person podded had no flag whatsoever, I would advice you (or your friend) to post in the Retribution 1.0 Issues thread.
