Just to clarify, the article only states that the guy was homeless and been in the area for awhile. Awhile to some could be a few days to weeks or even months. Now there is also no mentioning if the guy was a veteran or if he was even attempting to look for a job. I watched my great uncle go through a similar situation for several months after his divorce. Everything was stripped from him by his ex and was actively looking for work the entire time. The family had completely abandoned him and left him out to dry. I saw him quite frequently for I ran the streets in my teen years.

My point is, you can not judge a man's character based off 2 sentences from a biased source. The evidence of absence is not the absence of evidence.

About 40 years ago in my home town. A 90 year old lady was walking against a red light at a corner in front of a McDonalds. The big truck turning drove right over her and tore her apart. Her heart and lungs were lying in the road and when the driver looked at the back end double wheels he saw her head that was torn off sticking out from between the two wheels. Arms and legs spread all over.
The people all eating at the outside table at McDonalds could see all the gutz...

Ah... it's all starting to make sense now. I wondered what the possible rationale for this might have been... now I understand.

Not content with hosting the Olympics this year, it looks like we're in the process of gearing up for a bid for Death Race 2013 by turning the UK into a "target rich environment" I believe the phrase is.

I'm off to place £5 with William Hill on the West Midlands Serious Crime Squad, who lived up to their name admirably in this years event in Rio de Janeiro placing a well earned third after the Mrs Lawson Womens' Institute Drunk Driving team who were narrowly pipped for first place by the Half A Dozen D-List Celebs Fresh Out of Rehab team led by team captain Vince Neil.

I think so. Technically, the officer driving is 'at fault' for the collision, but the offender should be charged for the death (and, as I understand it, involuntary manslaughter covers any death that occurs as a result of an 'unlawful event', of which fleeing arrest is certainly an example.)

Not so.

There are two elements to a criminal offence, mens rea and actus reus.

Mens rea, the guilty mind. It would not be possible to argue in this instance that a reasonable person could assume that the death of a third party could result from the simple action of running away from the law. So; no mens rea.

Actus reus, the guilty act. Simply legging it isn't running the pedestrian over, so no actus reus either.

John Q Law driving the car must have been aware that a possible consequence of driving the car is losing control and killing a bystander, so mens rea is proven and as he was driving the car there's actus reus. Simple; copper is to blame.

...and yes I am aware that this took place in the USA but as the legal system there is based on the English system (only with more murdering of innocent thick folk using electricity) the basic principles are the same.
