my brother inlaw wants to transfer his account to me, does the account have to be active? and how much does a transfer cost... thanks guys

you can only legally transfer characters

Also read the character transfer rules in Character Bazaar.

Transfering single character costs 20 EUR/USD or 2 PLEX. Account must be active.

I have nothing to add to Xercodo's and malaire's excellent answers Smile but I would like to reiterate that account sharing or transfer is not allowed by the EVE Online EULA. Regardless of what anyone might tell you, your brother would be much better off transferring the character to you in the manner described above.
