This only applies to when you have just ganked someone right? I mean I see pirates cruising through high sec in small ships all the time. Certainly they are warping fast in small ships to avoid concord are they not?

I never really understood when and how this rule applies.

Being an outlaw (pirate) means the faction police are after you in highsec, and you can outrun them. Concord comes into play when someone is GCC (after a gank or you jump into highsec with GCC) and you cannot evade them.

They've (CCP) taken it even further now by ruling that delaying CONCORD death is illegal.

"bouncing" to gank multiple targets under GCC is also illegal. In the past you could shoot hulk #1, warp to guy #2 and shoot hulk #2, warp to guy #3 and shoot hulk #3 with fairly decent success on the second, and a loltastic chance on the third (basically CONCORD picks one or two guys off each warp in so depending on your gank squad).

Now you cant. You get GCC you grab your ankles and accept what CCP gives you. Anything else is illegal.
