Legal advice please

Ok, so here it is.. I slept with a girl on another girls comforter and she found out, I gave the comforter back to her and she demands that I pay for it, since she doesn't want it anymore, the comforter is in her possession now. She claims its a $400 one too, I don't have that type of money, can she sue me for anything on this matter? Thanks!

Good sir, this is so outlandish that I'm going to assume you're not trolling.
I seriously doubt that any judge in a court of law would actually even consider letting the case be heard.
That is to say another way, she'd very likely be laughed at.

That does not mean you shouldn't try to rectify things with her.
I'd give it a nice wash for her, unless your copulation is a much messier affair than most humans' (and wanders into the realm of messiness that xenomorph reproduction occupies) and washing would not return it to its previous state.

Still, if she has it now, you can probably ignore her demands (I would, though I'm not a great guide for what to do).

Though I doubt any comforter is worth $400 dollars.

Thanks for your response, She just came in here with the bag and it says $400!! her dad gave it to her too! She doesnt want to rectify anything, I changed my number, however she works next door from me!! I already offered washing it for her, and she doesnt want that done.. She left my work, and I see her ex boyfriend(theyre apperently back together) mumbling some stuff to me through the window... wtf!!!

And secondly, perhaps more importantly, I doubt any comforter that is worth $400 dollars would come in a bag.

Thirdly, if I were in this situation (which is impossible, but hypothetically speaking), I'd just ignore her because she's being crazy. If her ex or boyfriend or whoever hurts you because of an idiotic thing like this? Well, you'd have your court case there, I suppose.

There is the law and there is reality. Now I am not saying you should violate the law but here is how it goes.

You break it you bought it. The question is, did you break it? Did it get all messy and whatnot. Maybe you could get it cleaned somehow. If it is ruined then you bought it.

That being said, this is a small claims court matter and nothing may come of it.

I guarantee she will get nowhere. If it's not actually physically damaged she has absolutely no case (not that she really has one if there is damage, it's too small for most courts)

The most she could get, and that's if she gets the softest wussiest judge in the world, is money out of you to pay for cleaning.

I would suggest, let her sue. When at court, deny spilling the beans on the conforter and demand she proves it via DNA test of the stain. If she proceeds to seek DNA testing, refuse to provide sample. In the unlikely event sample is ordered by judge, stain material would be degraded and wont match... at this point you will say "I did not had sexual relationships with that woman".

If the test is a match, you can always claim accidental wet dream because the conforter smelled "sexy". Either way, the legal cost for the girl is gonna be too high, she wont do it.

I think it's pretty pathetic that she needs to have a new comforter because if not, then she is reminded of the fact that someone got lucky on it, something which no doubt would never ever happen to her, because she's so insular to anyone else and probably cries herself to sleep every night - after she's spent some time with her rabbit.

Buy her some AA batteries instead, it'll probably be of more use to her than a fuckin' $400 comforter.

If girl #1, who you slept with, had her own house, and was not sharing the house with girl #2 of comforter, then it is either; Girl #1's fault for having sex on the comforter she didn't tell you was girl #2's, OR it's girl #2's fault for leaving the comforter behind in girl #1's residence.

If the location was shared, perhaps that was different, but if it was NOT *currently* at the time being shared, it would surely be someone else's fault.

No one asks if it's ok to have sex on XYZ furniture group if there's only one renter/owner and no one else living there.

You may be off the hook completely!

I had a somewhat similar experience. Different story, but these elements were the same: a) Bedding b) Sex on bedding with one girl c) Subsequent girl considering that bedding forever and ever contaminated and unusable. I'm not sure the owner of the comforter in your situation wouldn't win in small claims court. In a lawsuit (tort), the plaintiff is seeking to be restored to the original condition she was in, before the damage was inflicted by the defendant. In this woman's mind, you can't restore her or her comforter to their original condition by dry cleaning, scrubbing with everclear, or purification by sunlight and holy water. Only a new, never-before-bopped-on comforter would restore her to her original condition. Actually that won't even work, because it still would't be the comforter her dad gave her. Which you, without her permission, did something really gross and disgusting on. You might be looking at replacing the comforter, plus paying additional damages for mental suffering due to the loss of an irreplaceable daddy gift.

If it were me, I'd first see if that bag and $400 receipt is legitimate. That's something that can be challenged in small claims court. This person might be so traumatized that she's resorting to dishonesty and fraud. Then, I'd check out the rotation of judges at your local small claims court. Hopefully there's a male judge in the rotation. If you're lucky enough and the case is scheduled with a male judge, you might have a chance. If it looks like you'll probably get a female judge, you might as well just cut your losses and settle out of court. You horny disgusting comforter soiler you. Big smile

Sir, you are a genius. If OP can't get completely off the hook, he can at least make girl #1 pay half of the costs of a new comforter. He should not individually for an action that was done with another person. How extremely sexist of the comforter owner to just blame everything on the male!

Need more details? She left the comforter at my place couple nights ago, she was suppose to come pick it up that night(though I knew she wanted to just come over and "hang out"), however I told her I was tired and going to bed, I had girl#2 come over, we got drunk I forgot she took pictures of us together all cuddling and she posted them on facebook, the next morning girl #1 looks at her facebook feed, and what does she see? Girl #2 and I cuddling, and guess what time that was posted on facebook at? 2:30am.. So i got a text from girl#1 in the morning saying "So.. Whats up?" I made plans with her that day to hang out, however I bailed on that, and she was like "Are you busy with someone else?! I saw on facebook!!" we do the whole arguing thing, I give the comforter back to her, that day at work. She texts me later on in the day asking if I slept with her, I said "Of course!" she calls me INSTANTLY, and was like "ON MY COMFORTER?!", I told her no.. obviously she doesnt believe me. I slept with both girl at my apt! She left the comforter at my apt, then had girl#2 come by and we did IT. So since she still has it, I dont think I need to pay for it.. also there was no damage done..Well hold on, maybe a small spot of blood from girl#2's downstairs, though I told her i had a nosebleed, though its totally unnoticeable and she hasn't brought anything up..
