Yes

If you got it as a gift for subscribing a new character, and your using it on said new char, you can petition to get it back. If you just bought one off the market then your hosed.

Well if you really want to PVP right away or need to do something dangerous, like undocking in Jita, you can train Infomorph Psychology and then join EACS. Just realize that a clone jump has a 24hr cool down. Frankly I'd say wait for the implant to expire so you get the full benefits of it.

I know about jump clones and I do have the skill trained already. I just paid a lot of money for the cerebral accelerator and I don't want to waste it.
