Should the impersonation of other players be made legal?

Not so long ago, there was a fairly big drama about impersonation and the way it is forbidden within EVE's EULA, however in now in mid 2014 - maybe it's time to review these anti-impersonation rules?

Here's a few reasons why impersonation (of other players, not devs) can be a positive thing for the sandbox:

  1. In the real world, so called corporate espionage relies heavily on being someone you're not. This often means posing as directors, using fake IDs, ec.t., to get yourself into a position where you can cause damage. Shouldn't this be the same in EVE?
  2. Behind some of the game's biggest alliances and coalitions, there is a huge metagame involving spying and scamming. I believe that the metagame is restricted by these anti-impersonation rules.
  3. Do these rules even make any sense at all? Of course, we shouldn't impersonate developers - but should we would be outlawed from even impersonating our own alts? If you'd even call that impersonation...

EVE is a game that thrives with nefarious player activity and its deep meta-game. Therefore, I'd like to take this chance to start a thread which can have a serious and constructive discussion around impersonation rules in the EULA.

Because it can cause players to become banned for things they did not do

I don't think you get it. Banning impersonation wasn't a punishment for something someone did, so we can just put the community on probation and lift the ban. It's a rule made for the better of the whole community.

In RL, if you get caught with a fake ID or doing harm to someone by impersonating someone else you go to jail. In EVE, you get banned. It's already pretty much the same.

It's not. Spying, scamming and metagame still exist and are still allowed. Besides, I really don't get what element of the game is not available to you if you can't impersonate someone?

Yes, they make sense and no, "impersonating" your own alts is not impersonation.

The reason I created "Solstice Project's Alt" last year was because of the change in the TOS that basically made it illegal to be Solstice Project's Alt, no matter who it is.

Iirc, but I think I do.

In EvE you can impersonate something you're not, you cannot impersonate someone you're not. There's an important fundamental difference.

One is rightfully banned. One is not. For the correct reasons.

That's not quite true.

You're not allowed to impersonate specific players, but you're also not allowed to impersonate corps, alliances or even claim your a representative of such.

For example, you're not allowed to claim you're a 'rental director' for one of the big 0.0 alliances.

So even when no individuals are involved, you're fairly restricted.

Inaccurate.

There were dozens of people during BurnJita trying to sell people spots on whitelists,
so they don't get ganked by the goons.

If they weren't allowed to do it, they would have gotten banhammered and nobody would do it anymore.

As long as no names are used, like ...
... "rental director of the goonswarm alliance" ...
... there's no issue.

Also, if you have so much money to give away ...

Also;

Are you aware that in WoW you aren't allowed to name your character according to the EULA?

ah, you would be banned (e: well. i imagine you'd be warned, not banned) for claiming to be a representative of a specific group despite being obviously not

i think solstice project's alt's unsociable behavior reflected poorly on the good name and exemplary reputation of solstice project
