Mint 16 graphical problem

Fresh install of mint 16, POL, Wine 1.7.9, everything seems ok till I log in then I'm greeted with

I have seen this several times now, I think you should be able to fix it by changing your ingame graphics settings. I believe it was either turning HDR on or off or something counter-intuitive like setting Shader Quality to something other than low. Try around a little.

Tried changing different combos of shaders and other settings the only thing that made a difference was HDR and that was only to make the screen whiter.

It might be worth firing up the launcher and checking eve is using dx9 not 11.

It seems you are using the open source Radeon driver, might be worth giving the proprietary one a try.

Already checked the DX11 and its set to DX9 as the card is an HD4850 (DX10.1) also the proprietary drivers don't support anything older the the HD6*** & the legacy drivers don't work with the version of x-server which comes with mint 16 (Ubuntu 13.10). Temped to install Ubuntu just to see if the problem is x-server related or not.
