question about criminal flag

scenario... 3 ships

Player A and Player B are in a fleet

Player A.. in miner.. mining astroids... launches shield rep drones and has them repair player B..
Player B .. in miner.. does the same thing

an hour later

Player C jumps in to Gank one of the previous 2

..............

Question..
will player A (or B) be flagged criminal for the repair drones repairing the other ship long before an attack takes place

no, you inherit the players flag, that means

Player A is clean > player B repairs A ship > B is clean
Player A is suspect > player B repairs A ship > B is suspect
Player A is criminal > player B repairs A ship > B is criminal

The exception is unless you're interfering with a duel, which causes suspect flag on player B regardless of player A status.

Possibly. But that requires drones aggressing the ganker. Like this:

Miner A has combat drones out
Miner B has shield drones out and repairing Miner A
Ganker C attacks Miner A
Miner A's drones attack Ganker C - this creates a limited engagement between A and C.
If Miner B's safety is set to yellow: Shield drones continue to repair A, making B a suspect for interfering in a limited engagement.
If Miner B's safety is set green: Shield drones stop repairing A.

But, again, this only applies if the miners attack the ganker.

If their safety is on green, the repairs would stop immediately and they would not get suspect.
If their safety is on yellow, they would get suspect as they are repairing someone with a limited engagement active (as a result of being shot at).

Not quite. In a ganking case, the limited engagement only starts when the one getting ganked fights back. Getting ganked in itself does not create a limited engagement, which means they can be repped without anyone getting suspect if they don't fight back.

Doesn't work that way, once ship C is flagged for criminal behavior, he's a free target by anyone, the Miner does not gain flags or have to change his safety to engage a criminal.

One of the industrial ships would have to fight back to trigger the suspect flag. You can rep people who are being attacked all you want, and don't inherit any flag as the repper - until the guy you are repping shoots back. Then your repping ship is considered fair game.
