Eve doesn't recognize touch input in a particularly useful manner in Windows 8. most specifically, it takes two taps to equal one left click, and the drag-to-scroll paradigm is not adopted.

There's a tool available called GestureWorks that offers the creation of touch overlays and remapping of touch gestures to useful key presses and mouse clicks.

Would using such a tool fall foul of any automation or memory scraping terms from the TOS?

I have no idea, but if you want an official response your chances here aren't too great. I'd suggest to use a petition for this kind of question.
