CCP and TOS writing

As a relatively new player I wanted to ask some of the old-timers about their previous experiences with CCP and EULAs/TOSs/etc.
The first published/advertized 'clarification' I saw was about cache scraping. CCP appeared to proclaim that it was completely against the rules and was a bannable offense. When asked about applications like EveMon the 'clarification' was that nobody was going to be banned for using it even though it was a scraper. The last thing I heard on the subject was that scraping was against the rules but CCP will allow it when they feel like it and can change their minds at any time and ban you for it anyhow.

Now I see we have another issue that has come around about impersonation. I can understand not allowing the impersonation of CCP staff but declaring all impersonation if against the rules doesn't sit right either. This change was touted as a 'minor clarification' which instead appears to have the potential to be game changing for a lot of people. The more CCP attempts to 'clarify' the changes the more muddled the waters seem to get.

So, my questions...
1. Is anyone else out there scratching their heads trying to figure out what is and is not allowed?
2. For anyone around longer than I have been - does this sort of confusion arise every time CCP makes a TOS/EULA change or clarification?

You would think that since CCP has figured out how many bugs can be caught and fixed by utilizing a test server for new changes to mechanics that they would take a similar philosophy with things like TOS and EULA. Why not have a group players can join to see proposed changes and comment. Perhaps then CCP would have a better grasp on how to clarify what they intended instead of muddying the waters further.

1) No, the 45+ page thread about it was everyone in agreement with CCP.
2) Only when they don't make any sense.

With the increase in shiptoasting, the Report timer needs to be shortened.

1. No, we all know what is and isn't allowed. In fact, we (the playerbase) understand clearly what they did. On the other hand, CCP and surprisingly, the CSM, seemed to be lacking in that same understanding.. despite the multiple explinations given.

2. Not necessarily regarding the TOS/EULA, and frankly there is clearly something more going on because I've seen CCP do a 180 on other issues that created this much problem. But they have done similar things in the past, the Roll-out of Incarna is probably the best example, which resulted in a massive player revolt when CCP continually kept refusing to fix the hundreds of bugs and overly complicated gameplay, and instead tried to push Incarna without any clear goal in mind.

The thing was, we had thought CCP had learned from the event and the CSM proved its worth on that day. The TOS issue is easily just as big, but CCP seems to have been blindsided and the CSM, at least from what Ali Aras stated, is at least partly to blame as well.

Well, is it the same CSM, also I doubt these gms were involved in incarna

So you choose to be uninformed and then whine when you get slapped with a ban? More power to you. I'd rather understand the rules I've been asked to abide by. I don't think it's unreasonable to expect they be clear and well defined.
