ugh ok..I didn't see anything "written in proof" on the forums "PER CCP RULES" so if you want to get all emo, I'm sure a dev could correct you.

He can sell to whoever he wants, nothing binding about it.

He sends ISK back to you, takes the higher bid. Nothing is set in stone until the transfer has started.
