My vote: Suicide. That a suicide would have failed doesn't matter to me. He intended to die, and he did. If he had hit a statue or tree instead of the ground we wouldn't be arguing if the groundskeeper was a murderer or if not trimming branches was negligent homicide. A shot on the way down is unusual, but not an exception IMHO. He got what he wanted. Death. I do however acknowledge that this is just opinion.

I'm voting suicide as well.
If a person jumps from a highway over pass and gets hit by a drunk driver.
The drunk driver gets charged for drunk driving, not homicide.

Like wise the shooters should get charge for attempted murder of the target they missed.
He had no intention of hitting the suicide, he had intention of hitting the wife.
So he should get charged for attempted homicide on the wife, but not homicide on the jumper.

There is a fine line between a post and a signature.

Technically, the husband assumed that the shotgun was empty because he said he only uses it to scare his wife. The hypothetical story mentions that the son knew that his father would pull the trigger thinking it was unloaded because he hated his mother. Therefore, the son is to be charged for attempted homicide. But since he gave up in life and wanted to kill himself, then let's just say that no one is charged with homicide and only one suicide is recorded.

I agree on the suicide as well. Regardless of there being a net this was the original intention. Everything beyond that point is just purely incidental.
